Right of withdrawal

If the Customer is a “Consumer,” as defined in Article 3 of the Consumer Code, they are entitled to the rights set forth in Articles 52 and following of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore have the right to withdraw from the Purchase Contract (hereinafter the “Right of Withdrawal”) for any reason, without explanation and without any penalty, by notifying the Seller within fourteen (14) days starting from the day on which the Customer or a third party designated by the Customer and different from the Carrier acquires physical possession of the goods.

However, DOT manifattura S.r.l., as a commercial choice and to better satisfy the customer’s needs, grants a term of fourteen (14) days to exercise the withdrawal right, starting from the day on which the Customer or a third party designated by the Customer and different from the Carrier acquires physical possession of the goods.

Please note that, as provided by current legislation, the Right of Withdrawal is excluded and therefore cannot be exercised if the products you purchased have been personalized, even with simple engravings, or have been custom-made for you upon your explicit request at the time of placing the Order.

The Withdrawal may apply to all (Total Withdrawal) or only part (Partial Withdrawal) of the products purchased by the Consumer from DOT manifattura S.r.l.

The customer wishing to exercise the Right of Withdrawal must notify DOT manifattura S.r.l. through an explicit declaration by following the instructions on the website www.manojewels.it in the “Easy Returns” section within fourteen (14) days from the day the Product is received.

The right of withdrawal is subject to the following conditions:

• Returned Products must be returned in their entirety and not as parts or components, even in the case of kits;

• Returned Products must not have been used, worn, washed, or damaged;

• Returned Products must be returned in their original packaging (meaning the packaging of the individual product);

• Returned Products must be sent to the Seller in a single shipment;

• In the event that the returned product(s) contributed to reaching a minimum order value to obtain a gift, the return of the said gift is included and mandatory along with the return of the product(s).

Withdrawal Form

In case of exercising the right of withdrawal, the customer is required to return the goods within fourteen (14) days from the day they communicated to DOT manifattura S.r.l. their intention to withdraw from the Contract pursuant to Article 57 of Legislative Decree 206/2005.

The return can be requested by following the instructions on the Website www.manojewels.it in the “Easy Returns” section.

It is possible to request a refund or an exchange: request a refund if you want to get back the amount spent for the items you want to return; request Store Credit if you want to exchange an item. Store Credit can also be used immediately by placing an Order on the Website. The new Order will be shipped by DOT manifattura S.r.l. only after receiving the returned items.

It is important that you contact customer service by email at info@manojewels.it to inform us of the day and time slot (morning or afternoon) when you want the courier to pick up the package.

You must place the items to be returned inside a well-sealed and protected box or envelope. The courier will already have the label with our shipping address and the customer reference related to the Order, so it is not necessary to write anything on the package.

The goods must be returned intact, in their original packaging, complete in all parts (including packaging and any documentation or accessories: manuals, cables, etc.) and with the related fiscal documentation. Without prejudice to the right to verify compliance with the above, DOT manifattura S.r.l. will refund the amount of the products subject to withdrawal within a maximum period of fourteen (14) days, including any shipping costs.

As provided by current legislation, to which reference is made, DOT manifattura S.r.l. may withhold the refund until receipt of the goods or, at its sole discretion, until the customer provides proof of having shipped the goods back to DOT manifattura S.r.l.

According to Article 59 of the Consumer Code (concerning “Exceptions to the right of withdrawal”) for distance and off-premises contracts, the right of withdrawal is excluded in the case of “supply of goods made to measure or clearly personalized.”

Refund Policy

If you exercise the Right of Withdrawal in accordance with the above conditions, the Seller is obliged to refund the amounts paid by the customer no later than fourteen (14) days from your decision to exercise the Right of Withdrawal, provided that within the same period the product has been returned and checked by the operators of DOT manifattura S.r.l.

The Seller will use the same payment method you used for the initial transaction to process the refund, unless you explicitly request the Seller to use a different method and the Seller agrees. If the Order was paid via PayPal, the refund will be made to the card or account used for the payment; if the Order was paid by Credit Card, the refund will be made to the same credit card (it is not possible to use a different card for the refund). If the Order was paid by Bank Transfer, the refund will be made by Bank Transfer: please contact customer service by email at info@manojewels.it to provide the IBAN for the refund. If the Order was paid by Cash on Delivery, the refund will be made by Bank Transfer: contact customer service at info@manojewels.it to provide the IBAN for the refund. Returns are processed by customer service within approximately one working week. Refund times on cards or bank accounts depend directly on the banks, which usually take about 2–3 working days to process the credit.

In case of simple Withdrawal, the only costs you will bear are the initial shipping costs of the purchased products. If you chose a delivery method different and more expensive than the standard one offered, the extra costs will not be refunded. All other expenses will be reimbursed by the Seller, including the shipping costs for the returned goods following the exercise of the Right of Withdrawal (except for additional costs resulting from your choice to use a delivery method different and more expensive than the standard delivery offered by the Seller).

The only case in which the customer is entitled to a refund of the price, shipping costs, and return costs is for the return of defective products or products delivered that do not correspond to the Order placed by the customer, or in case of damage due to transport or errors in shipping by the Seller. In case of return of the aforementioned products, DOT manifattura S.r.l. will cover the transport costs for returning the products. The return can be requested within fourteen (14) days of receipt of the items. If possible, please place the item(s) to be returned inside the same box used for our shipment; if this is not possible, for safety reasons we recommend that the return be well packed and protected. The courier will arrive with the prepaid label containing our shipping details and the customer reference.

Exchange of Products Store Credit

If you exercise the Right of Withdrawal in accordance with the above conditions, you may choose to request a refund or, through the return process, opt for receiving a store credit of equal value to the amount you spent, to be used for a new and different purchase on the website www.manojewels.it. You just need to click the option to confirm your choice. Please remember that the store credit must be used within twelve months from the date of issue and, after its expiration, it will no longer be valid and cannot be refunded.

Legal Warranty of Conformity

All products sold on the Site are covered by the Legal Warranty of Conformity provided by articles 128-135 of the Consumer Code (Legal Warranty).

More specifically, the warranty regime on products sold by DOT manifattura S.r.l. differs depending on whether the buyer is a "consumer" or a "professional" pursuant to Directive 1999/44/EC concerning certain aspects of the sale of consumer goods and associated guarantees.

If you purchase as a "consumer," you benefit from the legal warranty of conformity to which the seller is legally obliged for every good sold ("Legal Warranty").

The Legal Warranty — which DOT manifattura S.r.l. as the seller is obliged to provide — guarantees the product against defects of conformity with respect to the sales contract.

Who it applies to

The Legal Warranty is therefore reserved for consumers. It applies only to users who have made the purchase on the Site for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out. For those who have purchased on the Site and who do not qualify as consumers, the warranties for defects in the sold item, warranties for defects of promised and essential quality, and other warranties provided by the civil code apply, along with the related terms, expiration periods, and limitations.

When it applies

The seller (and therefore, with regard to purchases made on the Site www.manojewels.it) is responsible towards the consumer for any conformity defect existing at the time of product delivery and that appears within two years from such delivery. The conformity defect must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date it was discovered.

The warranty is valid provided the following conditions are met:

• The defect appears within 24 months from the date of product delivery;

• The Customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the Customer, unless this conflicts with mandatory prevailing laws of the Customer's habitual residence country;

Unless proven otherwise, it is presumed that conformity defects that appear within six months from the delivery date already existed at that date, unless this assumption is incompatible with the nature of the product or the nature of the conformity defect. Starting from the seventh month after product delivery, it is the consumer's burden to prove that the conformity defect already existed at the time of delivery.

To benefit from the Legal Warranty, you must first provide proof of the purchase date and delivery of the product. It is therefore advisable that you keep the purchase invoice or any other document that can certify the purchase date (for example, a credit card statement) and the delivery date.

Personalized Jewelry

Pursuant to art. 59, letter c) of Legislative Decree no. 206 of September 6, 2005 (Consumer Code), the right of withdrawal is excluded for the supply of goods made to measure or clearly personalized.

This provision implements what is established by Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011, which in art. 16, letter c) excludes from the right of withdrawal "the supply of goods made to measure or clearly personalized."

Therefore, it is not possible to exercise the right of withdrawal for:

• Jewelry personalized with engravings requested by the customer (e.g. names, dates, phrases);

• Jewelry made to measure or modified according to the customer’s specifications (e.g. choice of materials, stones, design);

• Jewelry ordered with sizes, lengths, or measurements specifically provided by the customer.

Furthermore, returns or refunds are not allowed in the following cases:

• Subjective dissatisfaction with the product (style, color, shape, aesthetic expectations);

• Size or measurement errors attributable to incorrect or incomplete data provided by the customer at the time of order.

This clause is also consistent with international guidelines on consumer protection in e-commerce, including:

• The UN Guidelines for Consumer Protection (United Nations, 2016 revision), which recognize the legitimacy of withdrawal limitations for personalized goods;

• The OECD Guidelines for Consumer Protection in E-commerce (OECD, 2016), which provide reasonable exceptions to the right of withdrawal in cases of non-resalable or made-to-measure products.

In any case, the legal warranty for defects of conformity and/or manufacturing defects pursuant to arts. 128 and following of the Consumer Code remains valid.

What is a defect of conformity

A defect of conformity occurs when the purchased good:

• is not suitable for the use for which goods of the same type are normally used;

• does not conform to the description given by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;

• does not have the usual qualities and performance of a good of the same type that the consumer can reasonably expect, also considering any statements made in advertising or labeling;

• is not suitable for the particular use desired by the consumer, which was made known to the seller at the time of the conclusion of the contract and accepted by the seller.

Therefore, the Legal Warranty does not cover any faults, malfunctions, or other defects caused by accidental events or by your responsibility, or by use of the product that is not in accordance with its intended purpose and/or with what is provided in the technical documentation attached to the product, if any, or in the related usage instructions. Regarding watches, accessories such as straps, cases, and glass are generally not covered by the warranty.

We also remind you that, although DOT manifattura S.r.l. constantly takes measures to ensure that the product photographs shown on the Site are faithful reproductions of the original products, including adopting all possible technological solutions to minimize inaccuracies, some variations may still occur due to the technical characteristics and color resolution capabilities of the computer you are using. Consequently, the Seller shall not be liable for any inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since such representations have a merely illustrative function.

What to do in the presence of a defect of conformity

In the case of a defect of conformity duly reported within the terms, you shall be entitled to:

Primarily, free repair or replacement of the good, at your choice, unless the requested remedy is objectively impossible or excessively burdensome compared to the other and, therefore, in the specific case, considering the type of sale, replacement, where possible in relation to the number of units still available for sale;

Secondarily (i.e., in the case that repair or replacement are impossible or excessively burdensome, or repair or replacement have not been carried out within a reasonable time, or repair or replacement previously carried out have caused significant inconvenience to the consumer), to a price reduction or contract termination, at your choice.

An excessively burdensome remedy is understood to be one that imposes unreasonable costs on the seller compared to the alternative remedies that can be undertaken, taking into account (i) the value the good would have if the defect of conformity did not exist; (ii) the extent of the defect of conformity; (iii) the possibility that the alternative remedy can be carried out without significant inconvenience to the consumer.

Refund or price reduction as a result of the application of the legal warranty

In the event of contract termination, DOT manifattura S.r.l. will refund you the total amount paid. In the case of a price reduction, DOT manifattura S.r.l. will refund you the amount of the previously agreed reduction.

The refund or reduction amount will be communicated to you via email and credited to the payment method or solution you chose.

Specifically, in the case of non-conformity, the Customer who entered into the contract as a Consumer will have the right to obtain the restoration of conformity of the products free of charge, by means of repair or replacement, or to obtain an appropriate price reduction or contract termination with respect to the contested goods and the consequent refund of the price.

Exchange or refund of a product with obvious manufacturing defects will be possible within 7 (seven) days from receipt of the product. Beyond this timeframe, if the item falls within the specifications of the authorized service centers (which differ for each brand), it may be sent for warranty repair. Warranty repair times vary depending on the product brand and may range from 45 to 60 working days.

Customer Communications

The Customer acknowledges, accepts, and consents that all communications, notifications, certifications, information, reports, and any documentation related to the transactions carried out, referring to the purchase of Products, will be sent to the email address provided at registration, with the possibility to download the information on durable media in the ways and within the limits provided by the Site.

Privacy Policy

The Customer’s data is processed by DOT manifattura S.r.l. in compliance with the provisions on personal data protection under Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 (GDPR).

Applicable law dispute resolution and competent court

These General Conditions of Sale are governed by Italian law and will be interpreted accordingly. Therefore, the interpretation, execution, and termination of the General Conditions of Sale are subject exclusively to Italian law and any disputes relating to and/or arising from them shall be resolved exclusively by the Italian judicial authority, as further specified below. In particular, if the Customer qualifies as a Consumer, any disputes shall be resolved by the court of the Customer’s domicile or residence according to the applicable law. If the Customer does not qualify as a Consumer, the parties mutually agree on the exclusive jurisdiction of the Court of Alessandria.

Online platform for alternative dispute resolution (ODR)

While DOT manifattura S.r.l. is always willing to seek an amicable solution to any disputes that may arise, also through the direct contacts provided, the Customer is informed that, pursuant to Article 14 of EU Regulation No. 524/2013 and the ODR resolution under Statutory Instrument No. 500/2015 effective from 15 February 2016, the European Commission has established an online platform for the resolution of disputes (“online dispute resolution” or ODR) arising from online purchases, accessible at the following link:

Cookies

The Site uses cookies to ensure normal navigation and the use of its features and, with the Customer’s consent, to send advertising messages in line with the preferences expressed during web browsing. For more information about the cookies used by the Site or to deny consent for their installation, the Customer can consult the information provided in the Cookie section.

Intellectual property

All elements of the Site, whether or not subject to registration of intellectual property rights (photos, product sheets, descriptions, layouts), are the exclusive property of DOT manifattura S.r.l. and cannot be used. All designs, models, trademarks, texts, visuals or sounds, comments, works, illustrations, images reproduced on the Site www.manojewels.it are protected by copyright, trademark rights, image rights, and any other applicable intellectual property rights. They are wholly owned by DOT manifattura S.r.l. or its partners.

Any form of reproduction or representation constituting counterfeiting may result in civil and criminal liability for the perpetrator.

Links referring to the Site www.manojewels.it that use “framing” or “in-line linking” techniques are strictly prohibited.

In any case, any such link or other content, even if tacitly authorized, must be immediately removed upon simple request by DOT manifattura S.r.l., under penalty of legal consequences.

Modification of the General Terms of Sale

Whenever there are changes to these General Terms of Sale, DOT manifattura S.r.l. will promptly publish the modified version on the Site.

The modified General Terms of Sale will become an integral part of new Contracts starting from the first Order placed by Customers after their publication on the Site. For Orders already placed before such communication, the previous version of the General Terms of Sale will apply.

Severability Clause

Should any present or future provision of the General Terms of Sale and/or the Contract be or become wholly or partially null and/or ineffective, or should there be a gap in the provisions of the General Terms of Sale and/or the Contract, the remaining provisions of the General Terms of Sale and the Contract shall remain valid and effective in any case. It is understood that DOT manifattura S.r.l. and the Customer will negotiate in good faith to integrate the gap or replace the null and/or ineffective clause with the aim of achieving the same results pursued by the invalid or ineffective clause and safeguarding the content, including the economic content, of the Contract.
