GENERAL TERMS AND CONDITIONS OF SALE


The offer and sale of products carried out on the website www.manojewels.it are governed by these General Terms and Conditions of Sale. For any other legal information, consult the sections: General Terms and Conditions of Sale, Privacy Policy and Right of Withdrawal. Before submitting their Purchase Order, the Customer is required to read these General Terms and Conditions of Sale carefully. Submitting the Purchase Order implies full knowledge and express acceptance both of the aforesaid General Terms and Conditions of Sale and of what is set out in the Order Form. Once the online purchase procedure has been completed, the Customer is required to print and retain these General Terms and Conditions of Sale and the relevant Order Form, already reviewed and accepted.


SUBJECT MATTER

These General Terms and Conditions of Sale concern the sale of products carried out online through the e-commerce service on the Site www.manojewels.it. In view of the high number of products made available, their main features and prices (including any additional cost) are clearly indicated directly on the Site. The products sold on the Site may be purchased and delivered exclusively in the Countries indicated in the Order Form. Any orders for shipments to be made outside such Countries will be automatically rejected during the Order processing procedure.


PARTIES

The products are sold directly by the company DOT manifattura S.r.l. (P.IVA 03105310134), in the person of its legal representative Mr. VESCOVO DAMIANO, with registered office at Circonvallazione Ovest Zona CO.IN.OR. Lotto 2/A n.40 Valenza (AL), 15048 Italia and share capital of euro 10.000,00 (fully paid up) (DOT manifattura), certified email (PEC) address: info@pec.manojewels.it, (hereinafter DOT manifattura S.r.l. or Seller) whose business is the retail and wholesale trade of jewelry, goldsmithing, costume jewelry, watches, silverware and other products connected and/or similar to the foregoing, and which makes available to all users the possibility of purchasing via the Internet products of different brands (hereinafter "Products") as well as a range of Services, including delivery Services, through the Site www.manojewels.it (hereinafter "Site"), of which DOT manifattura S.r.l. is the sole and exclusive owner.

GENERAL TERMS AND CONDITIONS OF SALE FOR ONLINE PURCHASES ON THE SITE WWW.MANOJEWELS.IT

These General Terms and Conditions of Sale ("General Terms and Conditions of Sale") are governed by the Consumer Code (Legislative Decree no. 206/2005 as amended) and by the rules on electronic commerce (Legislative Decree no. 70/2003 as amended) and apply exclusively to the distance sale via the web of the Products shown on the Site www.manojewels.it, next to which the "Buy online" button is present, and of the Services as indicated in these General Terms and Conditions of Sale as well as in the other sections of the Site. In the event of changes to the General Terms and Conditions of Sale, the Purchase Order, as specified in the following articles 3 and 4 of these General Terms and Conditions of Sale (hereinafter "Purchase Order"), will be subject to the General Terms and Conditions of Sale published on the Site at the time the Order is sent by the Customer (hereinafter "Customer").


These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on www.manojewels.it and do not, however, govern the provision of services or the sale of products by parties other than the Seller that are present on www.manojewels.it through links, banners or other hypertext connections. Before submitting orders and purchasing products and services from parties other than the Seller, we suggest that you check their sales conditions, because the Seller is not responsible for the provision of services by third parties other than the Seller.


The products are sold to the Customer identified by the data entered when filling in and sending the Order form in electronic format, with simultaneous acceptance of these General Terms and Conditions of Sale.

The product offers present on the Site www.manojewels.it are addressed to customers of legal age. If you are under 18, in order to purchase on the Site www.manojewels.it you must first have the consent of one of your parents or of a legal guardian.

Remember: this always applies, not only to our Site, but to all the sites you visit on the Internet: when, while browsing the Internet, you see or are asked for information that you do not understand or that is not clear to you, always ask your parents for help. By placing an Order through this website, you guarantee to us that you are of legal age (18 years) and that you have the legal capacity to enter into binding contracts.

The Customer is forbidden to enter false, and/or invented, and/or fictitious names in the online Order procedure and in further communications. The Seller reserves the right to take legal action against any violation and abuse, in the interest and for the protection of all consumers.

By accepting these Conditions of Sale, moreover, you release the Seller from any liability arising from the issuance of incorrect tax documents due to errors relating to the data provided by you at the time of entering the Order online, since you yourself as the customer are solely responsible for their correct entry.


By accepting these Conditions of Sale, moreover, you release the Seller from any liability arising from errors or delays in the customer's access to the website at the time of entering their data in the purchase procedure. As well as from the slowness or the impossibility of receiving the customer's Order confirmation or from any anomaly that may occur due to problems with the Internet network, or due to any other unforeseeable event beyond the control of DOT manifattura S.r.l..


By accepting these Conditions of Sale, moreover, you release the Seller from any liability arising from the non-operation of, or problems relating to, the email address provided by the customer for sending the Order confirmation.


OFFER TO THE PUBLIC AND SALES CONTRACT THROUGH THE E-COMMERCE SERVICE

The Products and Services with their respective Prices as present on the Site constitute an offer to the public in accordance with the terms specified in the General Terms and Conditions of Sale and on the Site itself. The Conditions of that offer apply exclusively to purchases made on the website www.manojewels.it. The sales contracts entered into on the Site and concerning the Products and Services (hereinafter "Sales Contract" or simply "Contract") are concluded with DOT manifattura S.r.l..


By online Sales Contract is meant the distance Contract concerning the sale of movable goods (hereinafter Products) entered into between you, as Customer, and DOT manifattura S.r.l., as Seller, within the framework of an e-commerce service organized by the Seller which, for this purpose, uses the distance communication technology known as the Internet.


To conclude the Contract for one or more Products, you must fill in the Order form in electronic format (hereinafter also Order) and send it to the Seller via the Internet following the relevant instructions.


The Order contains:


the reference to these General Terms and Conditions of Sale;

information and images of each Product and its price;

the means of payment you may use;

the delivery methods of the purchased Products, the times and the relevant shipping and delivery costs;

the reference to the conditions for exercising your Right of Withdrawal;

the methods and times for returning the purchased products.

Although DOT manifattura S.r.l. constantly adopts measures aimed at ensuring that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and the color resolution characteristics of the computer you use. Consequently, the Seller will not be liable for any inadequacy of the graphic representations of products shown on the Site where due to the aforesaid technical reasons, since such representations are merely illustrative.


ORDER FULFILLMENT AND CONCLUSION OF THE CONTRACT

By sending the Order through the Internet Site, you unconditionally accept and undertake to observe, in your relations with the Seller, these General Terms and Conditions of Sale.


Once the Order has been sent, the Seller will take it in charge for fulfillment and will send you, by email, an Order Confirmation (hereinafter "Order Confirmation") to the email address provided by the Customer. This Confirmation summarizes the chosen Products and Services, their Prices (including Delivery costs and the further costs relating to the additional Services requested by the Customer), the delivery address, the Order number (hereinafter "Order Number"), the General Terms and Conditions of Sale set out therein and any particular Conditions applicable to the individual Order and determined following specific requests of the Customer.


DOT manifattura S.r.l. reminds the Customer to check with the utmost attention and care the correctness of the data contained in the Order Confirmation and to communicate any corrections to DOT manifattura S.r.l. within 24 (twenty-four) hours of receiving it. The Order Number, generated by the system and communicated by DOT manifattura S.r.l., must be used by the Customer in every communication with DOT manifattura S.r.l.. Occasional unavailability of the Products offered may occur; in such a case, should the Products chosen by the Customer be unavailable, in whole or in part, DOT manifattura S.r.l. will inform the Customer.


The Seller retains the right, before sending the Order Confirmation, to request from you by email or at the telephone number you provided further information with reference to the Order you sent via the Internet.


The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect, or in the event of unavailability of the products. In these cases, we will inform you by email that the Contract is not concluded and that the Seller has not proceeded with your Order, specifying the reasons. In this case, the amount previously committed on the Customer's means of payment will be released.


Should the products presented on the website no longer be available or on sale after the Order has been sent, the Seller will promptly inform you, and in any case within thirty (30) working days from the day following the day on which you sent your Order to the Seller, of the possible unavailability of the ordered Products. In this case, the amount previously committed on the Customer's means of payment will be released.


Each sale made by the Seller through the online sales service may concern one or more products, with no quantity limit for each item.


Before concluding the Contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the Information Notice on the right of Withdrawal and on the processing of personal data Privacy Policy.


The Contract is concluded when the Seller, after receiving your Order Form and verifying the correctness of the data, has sent to the email address you provided through the Internet Site the confirmation of the product's shipment.


The Seller undertakes to deliver the ordered products to the Customer no later than 30 days from the date the Contract is concluded.


The language available for concluding the Contract with the Seller is Italian and the applicable law is Italian law.


DOT manifattura S.r.l. reserves the right to refuse orders from a customer with whom legal proceedings relating to a previous Order are ongoing. This applies equally to all cases in which DOT manifattura S.r.l. considers the customer unsuitable, including, by way of example, the case of previous breaches of Contract conditions for online purchases on the Site or for any other legitimate reason, especially where the customer has been involved in fraudulent activities of any kind.


SALE PRICES

Unless otherwise indicated in writing, all prices of the Products and of the shipping and delivery costs indicated on the website and in the Order are to be understood as inclusive of VAT and expressed in Euro. The validity of the prices indicated is always and only that indicated by the website at the time the Order is sent via the Internet. The prices of the Products, the offers and the costs of shipping and delivery may vary over time. If you send the order some time after your last visit to the website, make sure that the prices have not changed and therefore check the final sale price before submitting the relevant Order.


All Products are shipped directly from Italy. The prices of the Products and of the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are to be understood as not including any costs connected with customs duties and related taxes, which cannot be calculated in advance, where the shipment is made to non-EU Countries or to Countries in which the applicable legislation provides for import charges. In this case, the existence of any additional costs indicated above will be clearly mentioned during the entry and review of the Order.


These costs are therefore borne by the Customer and must be paid directly at the time of delivery of the Products, according to the indications specified in the Order Confirmation.


In the event of failure to collect, the seller will refund the cost of the product but not the shipping costs, the export and import costs connected with customs duties and related taxes, and the shipping costs for sending the product back to the seller.


All Prices of the Products indicated on the Site are inclusive of VAT. The delivery costs (hereinafter "Delivery Costs") and the costs relating to the Additional Services made available by DOT manifattura S.r.l., as indicated in the following articles of these General Terms and Conditions of Sale, are borne by the Customer and adequately detailed in the Purchase Order. The Price shown on the Site at the time the Order is sent applies to the Products and Services, except for offers or any Price changes occurring subsequently and indicated on the Site itself.


ORDER

The Purchase Order must be placed online through the order procedure on the Site (hereinafter "Order Procedure"), by clicking on the desired product, which will go into the Cart. In order to proceed with filling in the Purchase Order, the Customer may alternatively follow the methods below:


If the Customer is already registered on the Site through the dedicated Section, it will be sufficient to enter their access credentials (username and password) in the "Login" Section.


If the Customer is not a user of the Site, it will be sufficient to enter the required data, necessary to make the Purchase, in the dedicated form. DOT manifattura S.r.l. reminds the Customer that, before proceeding with the Purchase, they may at any time become a user of the Site by completing the relevant online registration through the "Register" page (to become a User of the Site).


The Customer correctly completes the Order Procedure if the Site does not display any error message (the system cannot detect errors relating to the data entered by the Customer in the field dedicated to the billing and shipping addresses).


In the "Your orders" section you can check the status of your Order, which can no longer be modified if it is in the "in processing", "ready", "shipped" and "closed" status.


If the Order has not yet been shipped, it is only possible to change the shipping address by contacting customer service by email at info@manojewels.it. It is advisable to precede the email request to change the shipping address with a telephone contact. Should the delivery not be successful, the customer must contact DOT manifattura S.r.l. immediately.


PAYMENT METHODS

To pay the price of the Products and the related shipping and delivery costs, you may follow one of the methods indicated in the Order form of the Site www.manojewels.it and summarized below.

Credit cards and prepaid cards

The customer may make payment by Visa, Mastercard, Visa Electron credit or debit card and/or other similar cards through the online credit card payment system, PayPal, by bank transfer or by cash on delivery (cash payment to the courier). DOT manifattura S.r.l. uses the highest security measures commercially available in the sector. Furthermore, the payment procedure takes place on a secure server that uses the SSL (Secure Socket Layer) protocol.

For online orders on our Site we accept credit card payments without any additional charge on the cost of the product and shipping. It is understood that the Customer must hold a valid credit card at the time of the Order of the Products purchased online and that the name on the credit card must be the same as that indicated on the billing details. In the absence of these conditions it will not be possible to proceed with the Order.

At the time of the online purchase, together with the Order Confirmation, the relevant banking institution will only commit the amount relating to the Order from the available balance of your credit card. The amount will be charged immediately at the time the payment is sent through the online platform.

At no point in the purchase procedure is DOT manifattura S.r.l. able to know the information relating to your credit card (for example, the credit card number or its expiry date), which is transmitted via a connection protected by an encrypted protocol directly to the Site of the party managing the electronic payment (banking institution or Paypal). No computer archive of the Seller will store such data.




Paypal

If you have a Paypal account, DOT manifattura S.r.l. gives you the possibility to make payments using directly the email and relevant password with which you registered on www.paypal.com.

Cash on Delivery

You can pay for your Order in cash directly to the courier who will deliver the products to you. In the case of cash on delivery payment, it is always advisable to prepare the cash in exact banknotes and coins. DOT manifattura S.r.l. cannot guarantee that all delivery staff will have change available for cash payment. Couriers must in no way ask for tips or amounts in excess of the Order total.

Bank transfer

You can pay for your Order quickly and securely using your home banking through the payment platform. The amount will be charged directly to your current account and shipment will take place after the credit has been received in the account.

Payment of the Order must be made at the time it is submitted to DOT manifattura S.r.l., with the possibility that it will be automatically cancelled by the seller if the credit is not made within 7 (seven) days thereafter.

You will be able to find the payment receipt, or the invoice if you are a VAT-registered party, on the Site in the "Your orders" section.


SHIPPING AND DELIVERY METHODS

Each shipment contains:

  • the ordered product(s);
  • any accompanying documentation required according to the Country of shipment;
  • any informational and marketing material;
  • any gadgets.

The delivery of the Products purchased through the Seller's website can take place in various ways.

Home delivery to the Customer

The purchased products will be delivered by the courier chosen by the Seller to the shipping address indicated by the Customer on the Order, with insured shipping. Consult the 24h Shipping section for additional information on costs, times and methods of shipping and Countries served.


Upon receipt of the goods at your home, we ask you to check the integrity of the packages at the time of delivery by the courier. In the event of anomalies, you must have them precisely noted and recorded by the courier and refuse the delivery, subject to mandatory notification to DOT manifattura S.r.l., also by contacting customer service by email at info@manojewels.it.

In Italy we ship by express courier within 24/72 hours with insured delivery and signature on delivery. Abroad we ship by express courier and the times vary depending on the Country. When the Order is shipped, you receive an email with the tracking code of the shipment, that is the tracking code with a link that leads to the courier's Site and to the status of the shipment. This number, the tracking code, is used to monitor the progress of the shipment and the expected delivery date. Orders with immediately available items, paid by credit card, PayPal or cash on delivery, placed by 16:00 are shipped the same evening or within 24 hours if the item is in one of our stores. For all orders that include items on pre-order, the date is indicated at the time of Order confirmation.


RIGHT OF WITHDRAWAL

If the Customer is a "Consumer", as defined in article 3 of the Consumer Code, they are entitled to the rights set out in articles 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore the right to withdraw from the Purchase Contract (hereinafter "Right of Withdrawal") for any reason, without explanation and without any penalty, by notifying the Seller within the term of fourteen (14) days, running from the day on which the Customer or a third party, designated by the Customer and other than the Carrier, acquires physical possession of the goods.

DOT manifattura S.r.l., however, as a commercial choice and to best meet the customer's needs, grants a term of thirty (30) days to exercise withdrawal, running from the day on which the Customer or a third party, designated by the Customer and other than the Carrier, acquires physical possession of the goods.

We remind you that, as provided by current legislation, the right of Withdrawal is excluded and therefore cannot be exercised in the event that the products you have purchased have been personalized, even with simple engravings, or have been made to measure for you, at your explicit request at the time of placing the Order.

The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the DOT manifattura S.r.l. Products purchased by the Consumer.

The customer who intends to exercise the right of Withdrawal must notify DOT manifattura S.r.l. by means of an explicit declaration, filling in the Withdrawal Form and sending it to the Contacts indicated, or by accessing the Site www.manojewels.it in the "Easy Returns" section, at the "EASY EXCHANGE AND RETURN space and by means of the instructions contained therein in the "HOW TO MAKE A RETURN (ITALY ONLY)" section.

By accessing the "NEED INFO?" section, at the "EASY EXCHANGE AND RETURN space and by means of the instructions contained therein in the "HOW TO MAKE A RETURN (ITALY ONLY)" section, within the term of 30 (thirty) days from the day of receipt of the Product, you can inform us of your intention to withdraw from the Contract, indicating which Products will be returned.

The right of withdrawal is subject to the following conditions:

the returned Products must be returned in their entirety and not parts or components of them, even in the case of a kit;

the returned Products must not have been used, worn, washed or damaged;

The returned products must be returned in their original packaging (meaning, by this, the packaging of the individual product);

the returned Products must be sent to the Seller in a single shipment;

In the event that the returned product(s) contributed to reaching a minimum order for obtaining a free gift, the return of the product also includes the mandatory return of the aforesaid free gift.

Withdrawal Form

In the event of exercising the right of Withdrawal, the customer is required to return the goods within 30 days from the day on which they notified DOT manifattura S.r.l. of their intention to withdraw from the Contract pursuant to art. 57 of Legislative Decree 206/2005.

The return can be requested through the DOT manifattura S.r.l. website within 30 days of receiving the items.

After logging in through the Site and entering your access credentials, access the Site www.manojewels.it in the "Easy Returns" section, at the "EASY EXCHANGE AND RETURN space and by means of the instructions contained therein in the "HOW TO MAKE A RETURN (ITALY ONLY)" section, select the relevant Order and request the return. After requesting the return, select the product (or products) you wish to return. You can request a refund or an exchange: request a refund if you want the return of the amount spent on the items you wish to return; request Store Credit if you want to exchange an item. Store Credit can also be used immediately by placing an Order on the Site. The new Order will be shipped by DOT manifattura S.r.l. only after receiving the items to be returned.

It is important that you contact customer service by email at info@manojewels.it to inform us of the day on which you wish the courier to come and collect the package and the time slot, morning or afternoon.

You must place the items to be returned inside a box or envelope that is well sealed and protected. The courier will already have the label with our shipping address and the reference of the customer who placed the Order, so there is no need to write anything on the package.

The goods must be returned intact, in their original packaging, complete in all their parts (including packaging and any documentation and accessories: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, DOT manifattura S.r.l. will refund the amount of the products subject to withdrawal within a maximum term of 30 days, including any shipping costs.

As provided by the current legislation, to which reference is made, DOT manifattura S.r.l. may suspend the refund until receipt of the goods or, at its sole discretion, until the customer has demonstrated that they have sent the goods back to DOT manifattura S.r.l.

According to article 59 of the Consumer Code (entitled "Exceptions to the right of withdrawal") for distance and off-premises contracts, the right of withdrawal is excluded in the case of "the supply of goods made to measure or clearly personalized".

Refund methods

If the right of Withdrawal is exercised by you in accordance with the previous conditions, the Seller is required to refund the amounts paid by the customer no later than 30 days from your decision to exercise the right of Withdrawal, but on condition that within the same term the product has been returned and verified by the operators of DOT manifattura S.r.l..

The Seller will use for the re-credit the same means of payment you used for the initial transaction, unless you explicitly ask the Seller to use a different means and the latter consents to it. If the Order was paid via Paypal, the refund will be made to the card or account used for the payment, while if the Order was paid by Credit Card, the refund will be made to the card used for the payment (it is not possible to use another card for the refund). If the Order was paid by Bank Transfer, the refund will be made by Bank Transfer: contact customer service by email at info@manojewels.it to inform us of the IBAN to which the transfer should be made. If the Order was paid by Cash on Delivery (cash payment to the courier), the refund will be made by Bank Transfer: contact customer service by email at info@manojewels.it to inform us of the IBAN to which the transfer should be made. Returns are processed by customer service in approximately one working week. The refund times on the card or current accounts depend directly on the banks, which generally take about 2/3 working days for the credit.

In the case of simple Withdrawal, the only costs you will bear will be the initial shipping costs of the Order of the purchased products. If you have chosen a type of delivery that is different and more expensive than the standard one offered, the additional costs will not be refunded. All other costs will be refunded to you by the Seller, including the delivery costs of the goods returned following the exercise of the right of Withdrawal (with the exception of the additional costs arising from your possible choice to use a delivery method that is different and more expensive than the standard type of delivery offered by the Seller).

The only case in which the customer will be entitled to a refund of the price, shipping costs and return costs is for the return of defective products or of delivered products that do not correspond to the Order placed by the customer, or in the event of damage to them due to transport or to shipping errors by the Seller itself. In the case of the return of the products just listed, DOT manifattura S.r.l. will bear the transport costs for returning the products. The return can be requested within 30 days of receiving the items. If possible, reseal the item or items to be returned inside the same box used for our shipment; if this is not possible, for safety reasons we recommend that the return be well packaged and protected. The courier will arrive already carrying the pre-printed label with our shipping details and the customer's reference.

Exchange of products, Value voucher (Store Credit)

Should the right of withdrawal be exercised by you in accordance with the previous conditions, you may choose to request a refund or, again through the return procedure, you may opt to obtain a voucher (Store Credit), of equal value to the amount you spent, to be used for a new and different purchase on the website www.manojewels.it; you will simply need to click on the option to confirm your choice. Remember that the voucher must be used within the final term of twelve months from the date of issue and, therefore, after its expiry it can no longer be used and you can no longer be refunded".

LEGAL GUARANTEE OF CONFORMITY

All Products sold on the Site are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Consumer Code (Legal Guarantee).

More precisely, the guarantee regime on the products sold by DOT manifattura S.r.l. differs depending on whether the buyer is a "consumer" or a "professional" within the meaning of Directive 1999/44/EC concerning "certain aspects of the sale of consumer goods and associated guarantees".

If you purchase as a "consumer", you benefit from the legal guarantee of conformity to which the seller is bound by law on every good sold ("Legal Guarantee").

The Legal Guarantee - to which DOT manifattura S.r.l. is bound as seller - guarantees the good against defects of conformity with respect to the sales contract.

TO WHOM IT APPLIES

The Legal Guarantee, therefore, is reserved for consumers. It therefore applies only to users who made the purchase on the Site for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. To those who purchased on the Site and who do not have the status of consumers, the guarantees for defects of the item sold, the guarantee for lack of promised and essential qualities and the other guarantees provided by the civil code, with the relevant terms, forfeitures and limitations, will apply.

WHEN IT APPLIES

The seller (and, therefore, as regards purchases made on the Site www.manojewels.it) is liable to the consumer for any defect of conformity existing at the time of delivery of the product and which becomes apparent within two years of that delivery. The defect of conformity must be reported to the seller, under penalty of forfeiture of the guarantee, within two months of the date on which it was discovered.

The guarantee is therefore valid provided that the conditions indicated below are met:

  • the defect becomes apparent within 24 months of the date of delivery of the products;
  • the Customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the latter, unless this conflicts with prevailing mandatory rules of the Customer's country of habitual residence;
  • Unless proven otherwise, defects of conformity that become apparent within six months of delivery of the product are presumed to have already existed on that date, unless this assumption is incompatible with the nature of the product or with the nature of the defect of conformity. From the seventh month following delivery of the product, it will instead be the consumer's burden to prove that the defect of conformity already existed at the time of its delivery.

In order to benefit from the Legal Guarantee, you will therefore first have to provide proof of the date of purchase and of delivery of the good. It is therefore advisable that you, for the purposes of such proof, keep the purchase invoice or any other document that can attest the date on which the purchase was made (for example the credit card statement) and the delivery date.

WHAT IS A DEFECT OF CONFORMITY

There is a defect of conformity when the purchased good:

  • is not suitable for the use for which goods of the same type are normally used;
  • does not conform to the description given by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;
  • does not have the usual qualities and performance of a good of the same type, which the consumer can reasonably expect, also taking into account the statements made in the advertising or on the labelling;
  • is not suitable for the particular use desired by the consumer and which was made known by the latter to the seller at the time the Contract was concluded and which the seller accepted.

Therefore excluded from the scope of the Legal Guarantee are any failures or malfunctions or defects of another kind caused by accidental events or by your responsibility, or by a use of the product that does not conform to its intended use and/or to what is provided in the technical documentation attached to the product, where existing, or in the instructions for use relating to it. As regards watches, accessories such as the strap, case and glass are not generally covered by the guarantee.

We also remind you that, although DOT manifattura S.r.l. constantly adopts measures aimed at ensuring that the photographs of the products shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and the color resolution characteristics of the computer you use. Consequently, the Seller will not be liable for any inadequacy of the graphic representations of products shown on the Site where due to the aforesaid technical reasons, since such representations are merely illustrative.

WHAT TO DO IN THE PRESENCE OF A DEFECT OF CONFORMITY

In the event of a defect of conformity duly reported within the terms, you will be entitled:

  • Primarily, to the free repair or replacement of the good, at your choice, unless the remedy requested is objectively impossible or excessively onerous compared to the other and, therefore, in the specific case, considering the type of sale, to replacement, where this is possible in relation to the number of units still available for sale;
  • Secondarily (that is, in the case where repair or replacement are impossible or excessively onerous, or the repair or replacement have not been carried out within reasonable terms, or the repair or replacement previously carried out have caused considerable inconvenience to the consumer), to the reduction of the price or the termination of the Contract, at your choice.

An excessively onerous remedy is understood to be one that imposes on the seller unreasonable expenses compared to the alternative remedies that can be pursued, taking into account (i) the value the good would have if there were no defect of conformity; (ii) the extent of the defect of conformity; (iii) the possibility that the alternative remedy can be pursued without considerable inconvenience to the consumer.

REFUND OR REDUCTION AS A CONSEQUENCE OF THE APPLICATION OF THE LEGAL GUARANTEE

In the event of termination of the Contract, DOT manifattura S.r.l. will return to you the Total Amount paid. In the event of a price reduction, DOT manifattura S.r.l. will return to you the amount of the reduction previously agreed.

The amount of the refund or reduction will be communicated to you by email and credited to the chosen means or payment solution.

In particular, in the event of lack of conformity, the Customer who entered into the Contract as a Consumer will be entitled to obtain the restoration of the conformity of the products free of charge, by repair or replacement, or to obtain an appropriate reduction of the price or the termination of the Contract with respect to the disputed goods and the consequent return of the price

The exchange or refund of a product with evident manufacturing defects will be possible within 7 (seven) days of receiving it; beyond these times, if the item falls within the specifications of the service centers (different for each brand) it can be taken in for repair under guarantee. The times for repairs under guarantee vary depending on the brands of the products and can range from 45 to 60 working days.

COMMUNICATIONS TO THE CUSTOMER

The Customer acknowledges, accepts and gives their consent to the fact that all communications, notifications, attestations, information, reports and, in any case, all documentation on the operations carried out, relating to the purchase of the Products, will be sent to the email address indicated at the time of registration, with the possibility of downloading the information on a durable medium in the manner and within the limits provided by the Site.

PRIVACY POLICY

The Customer's data are processed by DOT manifattura S.r.l. in accordance with the provisions of the legislation on the protection of personal data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

APPLICABLE LAW, DISPUTE RESOLUTION AND COMPETENT COURT

These General Terms and Conditions of Sale are governed by Italian law and will be interpreted in accordance with it. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law and any disputes inherent in and/or resulting from them must be resolved exclusively by the Italian judicial authority, as better specified below. In particular, where the Customer has the status of Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law. Where the Customer, on the other hand, does not have the status of consumer, the parties conventionally establish the exclusive jurisdiction of the Court of Alessandria.

Online platform for the alternative resolution of disputes (ODR)

Given that DOT manifattura S.r.l. is always available to seek an amicable solution to disputes that arise, also through the direct contacts indicated, the Customer is informed that, according to article 14 of EU Regulation no. 524/2013 and the resolution on ODR referred to in Statutory Instrument no. 500/2015 in force since 15 February 2016, the European Commission has established an online platform for the resolution of ODR ("online dispute resolution") disputes arising from the purchase of goods online, accessible at the following link:

INTELLECTUAL PROPERTY

AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE

On the occasion of each amendment to these General Terms and Conditions of Sale, DOT manifattura S.r.l. will promptly publish the amended ones on the Site.

The amended General Terms and Conditions of Sale will become an integral part of the new Contracts, as from the first Order submitted by Customers following their publication on the Site. In the case of Orders already submitted before such communication, the previous version of the General Terms and Conditions of Sale will apply.

SEVERABILITY CLAUSE

Should a present or future provision of the General Terms and Conditions of Sale and/or of the Contract be or become wholly or partly null and/or ineffective, or should there be a gap in the provisions of the General Terms and Conditions of Sale and/or of the Contract, the remaining provisions of the General Terms and Conditions of Sale and of the Contract will in any case remain valid and effective. It is understood that DOT manifattura S.r.l. and the Customer will undertake to negotiate in good faith the filling of the gap or the replacement of the null and/or ineffective clause with the aim of achieving the same results pursued by the invalid or ineffective clause and of safeguarding the content, including the economic content, of the Contract.
