The offer and sale of products carried out on the website www.manojewels.it are governed by these General Terms and Conditions of Sale. For any other legal information, please consult the following sections: General Terms and Conditions of Sale, Privacy Policy and Right of Withdrawal. The Customer is required, before submitting their Purchase Order, to carefully read these General Terms and Conditions of Sale. Submitting the Purchase Order implies full knowledge and express acceptance of both the aforementioned General Terms and Conditions of Sale and what is indicated in the Order Form. The Customer is required, once the online purchase procedure has been completed, to print and keep these General Terms and Conditions of Sale and the related Order Form, already viewed and accepted.

SUBJECT MATTER

These General Terms and Conditions of Sale govern the sale of products carried out online through the e-commerce service on the Website www.manojewels.it. Given the large number of products made available, their main characteristics and prices (including any additional costs) are clearly indicated directly on the Website. Products sold on the Website can be purchased and delivered exclusively to the countries indicated in the Order Form. Any orders for shipments to be made outside these countries will be automatically rejected during the Order processing procedure.

PARTIES

The products are sold directly by the company DOT manifattura S.r.l. (VAT No. 03105310134), represented by its legal representative Mr. VESCOVO DAMIANO, with registered office in Circonvallazione Ovest Zona CO.IN.OR. Lotto 2/A n.40 Valenza (AL), 15048 Italy and share capital of euro 10.000,00 (fully paid) (DOT manifattura), PEC email address: info@pec.manojewels.it, (hereinafter DOT manifattura S.r.l. or Seller) whose purpose is the retail and wholesale trade of jewelry, goldsmithing, costume jewelry, watches, silverware and other related and/or similar products, and which makes available to all users the possibility of purchasing products of various brands via the Internet (hereinafter “Products”) as well as a series of Services, including delivery Services, through the Website www.manojewels.it (hereinafter “Website”), of which DOT manifattura S.r.l. is the sole and exclusive owner.

GENERAL TERMS AND CONDITIONS OF SALE FOR ONLINE PURCHASES ON THE WEBSITE WWW.MANOJEWELS.IT

These General Terms and Conditions of Sale (“General Terms and Conditions of Sale”) are governed by the Consumer Code (Legislative Decree no. 206/2005, as amended) and by the regulations on e-commerce (Legislative Decree no. 70/2003, as amended) and apply exclusively to the distance sale via the web of the Products shown on the Website www.manojewels.it, next to which the “Buy online” button appears, and of the Services as indicated in these General Terms and Conditions of Sale as well as in the other sections of the Website. In the event of changes to the General Terms and Conditions of Sale, the Purchase Order, as specified in the following articles 3 and 4 of these General Terms and Conditions of Sale (hereinafter “Purchase Order”), will be subject to the General Terms and Conditions of Sale published on the Website at the time the Order is sent by the Customer (hereinafter “Customer”).

These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on www.manojewels.it and do not, however, govern the provision of services or the sale of products by parties other than the Seller that appear on www.manojewels.it via links, banners or other hyperlinks. Before placing orders and purchasing products and services from parties other than the Seller, we suggest verifying their terms of sale, since the Seller is not responsible for the provision of services by third parties other than the Seller.

Products are sold to the Customer identified by the data entered when completing and submitting the electronic Order Form, together with acceptance of these General Terms and Conditions of Sale.

The product offers on the Website www.manojewels.it are intended for customers of legal age. If you are under 18, in order to purchase on the Website www.manojewels.it you must first obtain the consent of one of your parents or a legal guardian.

Remember: this always applies, not only to our Website, but to every website you visit on the Internet: whenever, while browsing the Internet, you see or are asked for information you do not understand or that is not clear to you, always ask your parents for help. By placing an Order through this website, you guarantee to us that you are of legal age (18 years) and that you have the legal capacity to enter into binding contracts.

The Customer is prohibited from entering false, and/or invented, and/or fictitious names in the online Order procedure and in further communications. The Seller reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.

By accepting these Terms of Sale, you also release the Seller from any liability arising from the issuance of incorrect tax documents due to errors relating to the data you provided when entering the Order online, as you, as the customer, are solely responsible for entering it correctly.

By accepting these Terms of Sale, you also release the Seller from any liability arising from errors or delays in the customer's access to the website when entering their data in the purchase procedure. As well as from the slowness or inability to receive the customer's Order confirmation, or from any anomaly that may occur due to problems with the Internet network, or due to any other unforeseeable event independent of DOT manifattura S.r.l..

By accepting these Terms of Sale, you also release the Seller from any liability arising from the non-operation of or problems relating to the email address provided by the customer for sending the Order confirmation.

PUBLIC OFFER AND SALES CONTRACT THROUGH THE E-COMMERCE SERVICE

The Products and Services, together with their respective Prices as shown on the Website, constitute an offer to the public in accordance with the terms specified in the General Terms and Conditions of Sale and on the Website itself. The Terms of this offer apply exclusively to purchases made on the website www.manojewels.it. The sales contracts entered into on the Website relating to the Products and Services (hereinafter “Sales Contract” or simply “Contract”) are concluded with DOT manifattura S.r.l..

Online Sales Contract means the distance Contract for the sale of movable goods (hereinafter Products) entered into between you, as Customer, and DOT manifattura S.r.l., as Seller, within the framework of an e-commerce service organized by the Seller, which for this purpose uses the distance communication technology known as the Internet.

To conclude the Contract for one or more Products, you will need to fill in the electronic Order Form (hereinafter also Order) and send it to the Seller via the Internet following the relevant instructions.

The Order contains:

  • a reference to these General Terms and Conditions of Sale;
  • information and images of each Product and its price;
  • the payment methods you can use;
  • the delivery methods for the purchased Products, the shipping and delivery times and related costs;
  • a reference to the conditions for exercising your right of Withdrawal;
  • the methods and timeframes for returning the purchased products.

Although DOT manifattura S.r.l. constantly adopts measures aimed at ensuring that the photographs shown on the Website are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution features of the computer you are using. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products shown on the Website where due to the aforementioned technical reasons, since such representations serve a merely illustrative function.

ORDER FULFILLMENT AND CONCLUSION OF THE CONTRACT

By submitting the Order through the Website, you unconditionally accept and undertake to comply with these General Terms and Conditions of Sale in your dealings with the Seller.

Once the Order has been sent, the Seller will take charge of it for fulfillment and will send you, by email, an Order Confirmation (hereinafter “Order Confirmation”) to the email address provided by the Customer. This Confirmation summarizes the Products and Services chosen, their respective Prices (including Delivery costs and any additional costs relating to further Services requested by the Customer), the delivery address, the order number (hereinafter “Order Number”), the General Terms and Conditions of Sale provided therein and any special Conditions applicable to the individual Order and determined following specific requests from the Customer.

DOT manifattura S.r.l. reminds the Customer to check with the utmost care and attention the accuracy of the data contained in the Order Confirmation and to notify DOT manifattura S.r.l. of any corrections within 24 (twenty-four) hours of receiving it. The Order Number, generated by the system and communicated by DOT manifattura S.r.l., must be used by the Customer in every communication with DOT manifattura S.r.l.. Occasional unavailability of the Products offered may occur; in such cases, if the Products chosen by the Customer are not available, in whole or in part, DOT manifattura S.r.l. will notify the Customer.

The Seller retains the right, before sending the Order Confirmation, to request further information from you by email or by phone at the number you provided, in relation to the Order you sent via the Internet.

The Seller may not proceed with purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect, or in the event of unavailability of the products. In these cases, we will inform you by email that the Contract has not been concluded and that the Seller has not proceeded with your Order, specifying the reasons. In this case, the amount previously held on the Customer's payment method will be released.

If the products shown on the website are no longer available or for sale after the Order has been sent, the Seller will promptly inform you, in any case within thirty (30) working days from the day following the day on which you sent your Order to the Seller, of any unavailability of the ordered Products. In this case, the amount previously held on the Customer's payment method will be released.

Each sale made by the Seller through the online sales service may involve one or more products, with no quantity limit per item.

Before concluding the Contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the Notice on the right of Withdrawal and the Privacy Policy on the processing of personal data.

The Contract is concluded when the Seller, after receiving your Order Form and verifying the accuracy of the data, has sent you, at the email address you provided through the website, confirmation of the product's shipment.

The Seller undertakes to deliver the ordered products to the Customer within and no later than 30 days from the date the Contract is concluded.

The language available for concluding the Contract with the Seller is Italian and the applicable law is Italian law.

DOT manifattura S.r.l. reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous Order. This applies equally to all cases in which DOT manifattura S.r.l. considers the customer unsuitable, including, by way of example, cases of previous violations of Contract terms for online purchases on the Website or for any other legitimate reason, especially where the customer has been involved in fraudulent activity of any kind.

SALE PRICES

Unless otherwise indicated in writing, all prices of Products and shipping and delivery costs shown on the website and in the Order are to be considered VAT included and expressed in Euros. The validity of the prices shown is always and only that indicated by the website at the time the Order is sent via the Internet. The prices of Products, offers and shipping and delivery costs may vary over time. If you send your order some time after your last visit to the website, make sure the prices have not changed and check the final sale price before submitting the relevant Order.

All Products are shipped directly from Italy. The prices of Products and shipping and delivery costs shown on the website and in the Order, unless otherwise specified, are to be considered exclusive of any costs related to customs duties and related taxes, which cannot be calculated in advance, where shipping takes place to non-EU countries or to countries where current regulations provide for import charges. In this case, the existence of any additional costs indicated above will be clearly mentioned when entering and reviewing the Order.

These costs are therefore borne by the Customer and must be paid directly at the time of delivery of the Products, according to the instructions specified in the Order Confirmation.

In the event of failure to collect the product, the seller will refund the cost of the product but not the shipping costs, outbound and inbound costs related to customs duties and related taxes, or the shipping costs for returning the product to the seller.

All Product Prices shown on the Website are inclusive of VAT. Delivery costs (hereinafter “Delivery Costs”) and costs related to the Additional Services made available by DOT manifattura S.r.l., as indicated in the following articles of these General Terms and Conditions of Sale, are borne by the Customer and adequately detailed in the Purchase Order. The Price shown on the Website at the time the Order is sent applies to the Products and Services, except for offers or any Price changes made subsequently and indicated on the website itself.

ORDER

The Purchase Order must be placed online through the order procedure on the Website (hereinafter “Order Procedure”), by clicking on the desired product, which will be added to the Cart. In order to proceed with completing the Purchase Order, the Customer may alternatively follow the methods below:

If the Customer is already registered on the Website through the relevant Section, it will be sufficient to enter their login credentials (username and password) in the “Login” Section.

If the Customer is not a user of the Website, it will be sufficient to enter the required data in the appropriate form, necessary in order to make the Purchase. DOT manifattura S.r.l. reminds the Customer that, before proceeding with the Purchase, they can at any time become a user of the Website by completing the relevant registration online through the “Register” page (to become a User of the Website).

The Customer correctly completes the Order Procedure if the website does not display any error message (the system cannot detect errors relating to the data entered by the Customer in the field dedicated to billing and shipping addresses).

In the “Your orders” section you can check the status of your Order, which can no longer be modified if it is in the status “processing”, “ready”, “shipped” or “closed”.

If the Order has not yet been shipped, it is only possible to change the shipping address by contacting customer service by email at info@manojewels.it. It is advisable to precede the email request to change the shipping address with a phone contact. If delivery is not successful, the customer must immediately contact DOT manifattura S.r.l..
